1. BetterStream hosts no content

BetterStream is a media player. It does not host, store, index, link to, or provide any video, audio, channel list or playlist. Every stream played in BetterStream comes from a playlist that the user added and that is hosted by a third party the user chose. Kaptivate has no access to those playlists and cannot remove content from them.

If you believe a stream infringes your rights, please send your notice to the party that hosts the stream or playlist — for example the playlist provider or the hosting company of the server named in the stream address.

2. What we can act on

We will respond to notices about material that Kaptivate itself publishes, such as:

• the BetterStream app listings in the Apple App Store, Google Play or other stores,
• the BetterStream website (betterstreamtv.com) and its downloads,
• screenshots, marketing text or artwork we publish.

3. How to send a notice (17 U.S.C. § 512(c)(3))

Send a written notice to our designated agent that includes:

1. your physical or electronic signature (or that of a person authorized to act for the owner);
2. identification of the copyrighted work claimed to be infringed;
3. identification of the material on our app listing or website that you claim is infringing, with enough detail (e.g. URL) for us to find it;
4. your name, address, telephone number and email address;
5. a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law;
6. a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner's behalf.

4. Counter-notice

If material we published was removed because of a notice and you believe that was a mistake, you may send a counter-notice containing the elements of 17 U.S.C. § 512(g)(3). We may restore the material after 10–14 business days unless the complainant tells us they have filed a court action.

5. Repeat infringers

Where Kaptivate provides accounts, we will terminate, in appropriate circumstances, the accounts of users who are repeat infringers of our policies on the material we host. Kaptivate hosts no user content, so this applies only to material a user asks us to publish (none at present).

6. Misrepresentation

Knowingly misrepresenting that material is infringing (or was removed by mistake) may make you liable for damages under 17 U.S.C. § 512(f).
